Refund Policy
This Refund Policy (the "Policy") describes the circumstances under which fees paid for the products and services of Drog AI, a service of Drogoz Network (the "Services"), may or may not be refunded. It forms part of, and is incorporated by reference into, the Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service. By purchasing or using the Services, you acknowledge and accept this Policy.
1. General Principle
Because the Services grant immediate, time-limited access to software and provisioned resources, all payments are generally final and non-refundable once access has been made available. This includes subscription fees, renewal fees, and amounts credited to your Account balance. You are responsible for evaluating whether the Services meet your requirements before purchasing, including by using any trial, demonstration, or documentation made available.
2. Subscription and Rental Fees
- Subscription fees are charged in advance for each billing period and are non-refundable for the period in which they are charged, whether or not you use the Services during that period.
- Cancelling a Subscription stops future renewals; it does not entitle you to a refund of fees already paid for the current or prior periods.
- Upon cancellation, you generally retain access to paid features until the end of the current paid period, after which access ceases.
- We do not provide pro-rated refunds for partial periods, downgrades, or unused time, except where required by mandatory Applicable Law.
3. Usage-Based Charges and Account Balance
Certain features are billed based on actual usage (for example, per-minute or per-second charges for communications). Usage-based charges reflect resources already consumed and are non-refundable. Amounts deposited to your Account balance are intended for use within the Services and are not redeemable for cash except where mandatory Applicable Law requires otherwise.
4. Cryptocurrency Payments
Where the Services are paid for in cryptocurrency or other digital assets:
- we cannot reverse or "charge back" a confirmed blockchain transaction;
- you bear all risk arising from exchange-rate volatility between initiation and confirmation of a payment;
- funds sent to an incorrect address, on an unsupported network, in an incorrect amount, or outside any stated window may be permanently and irrecoverably lost, and Drog AI is not responsible for such losses;
- in the limited and exceptional cases where Drog AI, in its sole discretion, agrees to issue any goodwill credit or refund, it may do so as an Account credit valued at the amount actually received (net of network fees), rather than as a reversal of the original transaction.
5. Circumstances Where Refunds Are Not Available
Without limitation, refunds will not be provided in the following circumstances:
- where your Account has been suspended or terminated for violation of the Terms of Service or the Acceptable Use Policy;
- for dissatisfaction that does not amount to a material, unremedied failure of the Services attributable to Drog AI;
- for downtime or disruption caused by factors beyond our reasonable control, including force-majeure events and third-party providers;
- for your failure to use, configure, or understand the Services;
- for change of mind after access has been provided; or
- where a chargeback or payment dispute is initiated in bad faith.
6. Limited Discretionary Refunds
Drog AI may, entirely at its own discretion and without creating any obligation or precedent, elect to issue a partial or full refund or Account credit in exceptional circumstances — for example, a verified duplicate charge, or a sustained failure of a core feature that we are unable to remedy within a reasonable time and that is directly attributable to us. Any such refund does not waive this Policy with respect to future transactions.
7. How to Request a Refund
To request consideration of a refund, contact legal@drog.ai within fourteen (14) days of the relevant charge, including your Account details, the transaction identifier, the amount, and a clear description of the issue. We will review eligible requests and respond within a reasonable time. Submitting a request does not guarantee a refund.
8. Chargebacks and Payment Disputes
If you believe a charge is incorrect, you agree to contact us first to resolve the matter before initiating a chargeback or payment dispute. Initiating a chargeback without first seeking resolution, or in bad faith, may result in suspension or termination of your Account and forfeiture of any remaining balance to the extent permitted by Applicable Law, in addition to any other remedies available to us.
9. Taxes
Refunds, where granted, are net of any applicable taxes, duties, network fees, and processing costs. You remain responsible for any taxes associated with your purchase.
10. Statutory Rights
Nothing in this Policy is intended to exclude or limit any non-waivable statutory rights that may apply to you as a consumer under mandatory Applicable Law. Where such rights apply, this Policy operates only to the extent permitted by that law.
11. Changes to this Policy
We may update this Policy from time to time. The "Last updated" date above reflects the most recent revision. Purchases are governed by the version of this Policy in effect at the time of the transaction.
